1. Terms of Use - Coachi

1. Who we are
These Terms of Use (the Terms) apply to your use of the Coachi mobile app, website, and related services (the Service).
The Service is operated by Sport Autonomy (“Coachi”, “we”, “us”).
Our Privacy Policy explains how we handle personal data. It is available in-app and on our store listings.
By downloading, accessing, or using the Service you agree to these Terms. If you do not agree, you must not use the Service.
2. Age, eligibility and account
- Minimum age: You must be 13 years or older to use the Service.
- Under-18s: If you are aged 13–17, you confirm you have your parent’s/guardian’s consent to use the Service and to purchase any subscriptions.
- Account: You must provide accurate information and keep your login credentials secure. You are responsible for all activity on your account.
3. What Coachi does (and does not do)
- Coaching only: Coachi analyses videos you choose to upload and (if enabled) sensor data to generate training metrics and feedback for skiing technique.
- Not a medical device: Coachi is not a medical device and does not provide medical advice. Consult a medical professional if you have health concerns.
- No guarantees: We do not guarantee specific results or performance improvements.
4. Health, safety and your responsibilities
Skiing and related activities carry inherent risks of injury. You are solely responsible for:
- assessing the suitability of any activity;
- using appropriate equipment and protective gear; and
- following resort rules and local laws.
You acknowledge these risks and agree that you use the Service at your own risk.
5. Subscriptions, payments and trials
- Payment: Premium features are purchased via the Apple App Store or Google Play.
We do not process payments directly.- Renewals: Subscriptions automatically renew unless cancelled at least 24 hours before the current term ends.
- Manage/cancel: You can manage or cancel in your Apple ID or Google Play settings.
- Refunds: Any refunds are issued by Apple/Google under their policies. We cannot issue refunds directly.
- Trials/promotions: Trials may convert to paid subscriptions unless cancelled before expiry. Promotional terms shown in-app or on the store form part of these Terms.
6. Consent for video analysis and data use
Video analysis is optional. Before your first use this function, we ask for your explicit consent to analyse your video and movement data to provide coaching feedback.
Separately from video analysis consent, certain diagnostic and performance data is collected automatically from the moment the app launches. This includes crash reports, performance traces, and anonymous session identifiers, collected via Embrace.io and OpenTelemetry. This collection does not require your consent as it is necessary for the safe and stable operation of the Service and is carried out on the basis of our legitimate interests. Full details are set out in our Privacy Policy.

7. Your content
- You remain the owner of videos and content you upload (User Content).
- You grant Coachi a worldwide, non-exclusive, royalty-free licence to host, process, reproduce, and display your User Content only to provide the Service (including AI feedback, quality assurance, and troubleshooting).
- We do not use your User Content for advertising. If we want to use it for marketing or training purposes, we will ask for separate permission.
- You must not upload unlawful, infringing, harmful, defamatory, obscene, hateful, or malicious content. We may remove content or suspend accounts where reasonably necessary.
8. Licence to use the app
We grant you a limited, personal, non-transferable, revocable licence to install and use the app on devices you own or control, in line with these Terms and the Apple/Google usage rules.
You must not reverse-engineer, tamper with, or circumvent security features.
9. Acceptable use
You agree not to:
- interfere with or disrupt the Service;
- access areas of the Service not intended for you;
- misuse reporting or support tools;
- upload viruses, spyware, or malicious code;
- use automated tools to access the Service (except permitted APIs); or
- infringe intellectual property or privacy rights.
10. AI feedback and limitationsHow it works: We use computer-vision and AI models to analyse your video and (if enabled) sensor data, generating metrics and coaching feedback.
Limitations: AI outputs may be incomplete or inaccurate. Treat them as advisory only.
Do not rely solely on AI feedback for safety-critical decisions.
No legal effect: AI outputs do not make decisions with legal or similarly significant effects.
11. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted access. Features may be updated, suspended, or discontinued. Where changes materially affect you, we will give reasonable notice where possible.
12. Third-party services and links
The Service uses several third-party providers to operate key parts of its infrastructure and functionality. Apple App Store and Google Play are used for subscription billing and app distribution. Amazon Web Services (AWS), located in the EU-West-1 region (Ireland), provides cloud hosting, authentication through AWS Cognito, and data storage through DynamoDB. AWS CloudWatch is used for application logging and operational monitoring. Embrace.ioprovides mobile crash reporting and performance monitoring, and OpenTelemetry is used for application performance tracing and diagnostics.
By using the Service, you acknowledge that your data may be processed by these providers in accordance with their own terms and privacy policies. Coachi is not responsible for the content, terms, or practices of these third-party services. Links to their privacy policies are provided within the Coachi Privacy Policy. However, we take reasonable steps to ensure that all third-party processors handle data under appropriate contractual and data protection safeguards.

13. Intellectual property
We and our licensors own all intellectual property in the Service, including software, models, text, graphics, and trademarks. You may not copy or reuse them except as permitted by these Terms.
14. Feedback you provide to us
If you provide suggestions or ideas, you grant us a perpetual, worldwide, royalty- free licence to use them without obligation to you.
15. Suspension and termination
We may suspend or terminate your account if you materially breach these Terms, misuse the Service, or where required by law or platform rules. You may stop using the Service at any time and can delete your account in Settings.
16. Warranties and disclaimers
The Service is provided on an “as is” and “as available” basis. To the extent permitted by law, we exclude all warranties and representations, including as to accuracy, fitness for purpose, and availability.
This does not affect your statutory consumer rights.
17. Liability
We are not liable for:- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation; or
- any other liability that cannot be excluded by law.
Subject to this, we are not liable for:
- indirect or consequential loss;
- loss of profits, data, or goodwill; or
- losses from relying solely on AI feedback.
In addition to the exclusions already listed, we are not liable for:
• service interruptions or data loss arising from the failure of third-party infrastructure providers, including but not limited to AWS, Embrace.io, or Apple/Google platform services;
• inaccuracies in diagnostic or performance data collected by third-party monitoring tools; or
• any loss arising from the use of anonymised session or diagnostic data in ways consistent with our Privacy Policy.
Nothing in this section limits our liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
18. Consumer rights (UK/EU)
If you are a consumer in the UK/EU, you have statutory rights for digital content and services. These Terms do not affect those rights.
19. App store terms
These Terms are between you and Sport Autonomy, not Apple or Google. Apple and Google are third-party beneficiaries and may enforce relevant terms.
20. Governing law and venue
These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction, subject to mandatory consumer protections in your country.
21. Changes to these Terms
We may update these Terms to reflect changes to the Service, law, or platform rules.
We will post updates in-app and change the “Last updated” date. Material changes will be notified in advance where practicable.
Section 22A — Future authentication changes
We intend to introduce Sign in with Apple and Sign in with Google in a future version of the app. When this feature is released:
• these Terms will be updated to reflect account creation, login, and deletion rights;
• our Privacy Policy will be updated to reflect the additional personal data collected (name, email address);
• you will be notified of material changes before they take effect; and
• Sign in with Apple will be offered alongside any other social login option, in accordance with Apple’s App Store guidelines.
23. Entire agreement
These Terms, together with our Privacy Policy and any promotional terms, form the entire agreement between you and us for the Service.
We may assign our rights and obligations. You may not transfer your rights without our consent.
